Terms of use
Last updated: 26 October 2026 · Version 2026-10
These terms govern the use of Arraigo Spain by agencies, gestorías and professionals (the “Agency”) that create an account. The service is provided by Younes Sbai (NIF 08117733K), hereinafter “Arraigo Spain”. By ticking the acceptance box in the private space, the Agency's manager declares that they are authorised to bind it and accepts these terms and the data processing agreement.
1. The service
Arraigo Spain provides: an indicative immigration diagnosis with the Agency's name, logo and details; receipt of the contacts who request it; a private space with records, prepared messages and follow-up; and settings for the Agency to enter its offices, hours, consultation price, booking calendar and payment link.
Arraigo Spain does not collect consultation fees or the Agency's clients' fees: these payments are made directly to the Agency through its own tools.
2. Registration and verification
The Agency must provide accurate details (legal name, tax ID, address, manager) and a document proving that immigration is part of its business. Arraigo Spain may refuse or suspend an account if the details cannot be verified. Later changes to the legal name, tax ID, trade name, document or domain go live after a new verification.
3. Pilot phase
During the launch phase, Arraigo Spain may invite agencies to a free pilot programme. During the pilot: nothing is charged, there is no commitment and the Agency may stop at any time. At the end of the pilot, Arraigo Spain will offer the Agency paid terms at least 30 days in advance; if it does not accept them, the service stops at no cost and clause 10 applies.
4. Trial period
Agencies that sign up outside the pilot get a 30-day free trial with every feature from the date their profile is approved. At the end, the diagnosis is paused until they subscribe; contacts already received remain accessible.
5. Price and payment
The price is the one published on the website or communicated in writing to the Agency before subscribing, plus VAT. It consists of a base fee including one office and three users (including the manager) and supplements for each additional active office and user. It is paid monthly or yearly in advance. Price changes are notified 30 days in advance and the Agency may cancel before they apply.
6. The Agency's obligations
- Use the service for its professional activity and in accordance with the law.
- Review each case before advising: the diagnosis is initial guidance and the Agency is solely responsible for the advice it gives its clients.
- Reply to contacts diligently and respect each person's chosen channel and consent.
- Keep its access credentials confidential and remove access for people who leave its team.
- Comply, as data controller, with data protection law towards its prospective clients.
7. Non-solicitation
The contacts and clients who arrive through the Agency's diagnosis belong to the Agency. Arraigo Spain undertakes not to contact them, not to offer them its own or third-party services, not to refer them to another agency and not to use or share them for any purpose, during the contract and after it ends.
8. Support
Arraigo Spain has no access to the Agency's space. If the Agency needs help, it can authorise a 7-day support access from its settings, which closes automatically and which it can close earlier at any time. During support, clients' contact details and internal notes stay hidden, contacts and team are read-only, every visit is logged and visible to the Agency, and actions appear in the history under “Arraigo Spain support”.
9. Liability
Arraigo Spain reviews the diagnosis content carefully, but immigration rules change and every case is different: it does not guarantee that a result is correct for a given person or that any permit will be granted. Arraigo Spain is not liable for decisions taken without a professional's review, or for third-party services the Agency connects (WhatsApp, calendar, payments). Except in cases of wilful misconduct or gross negligence, Arraigo Spain's liability is limited to the amounts paid by the Agency in the twelve months before the event giving rise to it.
Arraigo Spain aims to keep the service available at all times but may interrupt it for maintenance or for reasons beyond its control.
10. Cancellation and end of service
The Agency may cancel at any time by writing to info@arraigospain.com; cancellation takes effect at the end of the period already paid. Arraigo Spain may terminate with 30 days' notice, or immediately in case of fraudulent use or serious breach. After cancellation, the Agency has 30 days to request an export of its contacts; the data is then deleted under the data processing agreement.
11. Intellectual property
The software, diagnosis texts and design belong to Arraigo Spain. The Agency receives a right of use for the duration of the contract. The Agency keeps ownership of its name, logo and data, and authorises Arraigo Spain to display them in its diagnosis.
12. Changes to these terms
Changes are notified by email and in the space 30 days in advance, and the Agency will be asked to accept the new version. Each acceptance is recorded with its date, the person and the version.
13. Governing law and jurisdiction
These terms are governed by Spanish law. The parties submit to the courts of Málaga.
